Appellate Division has ruled that there is no bar to BNP MP Sarowar Alamgir of Chittagong-2 attending parliamentary sessions. However, the Jamaat candidate may file a regular appeal if desired.
A four-member bench headed by the Chief Justice delivered the order on Wednesday.
Earlier on July 9, the High Court declared Sarowar Alamgir’s nomination valid, overturning the Election Commission's decision to cancel his candidacy.
Following the High Court's judgment, an official gazette was issued declaring Sarowar victorious, and he took oath as a Member of Parliament that evening.
Jamaat candidate Nurul Islam subsequently petitioned the Appellate Division to stay the High Court ruling.
Sarowar’s nomination had previously been canceled on January 18 over allegations of loan default.
